A Gratifying and Swift Dismissal of the Ridiculous Lawsuit Against the NCAA

It is gratifying to note a swift rejection of the ill-advised lawsuit filed by Governor Corbett against the National Collegiate Athletic Association (NCAA) in an eleventh-hour effort to reverse the sanctions appropriately dispensed to Penn State University in the aftermath of the Jerry Sandusky serial rape atrocity.

 

The governor initially expressed acceptance of the sanctions.  What changed?  Additionally, what standing did he have as a mere Trustee to attempt to invalidate an agreement that was made between the organization and the University by those in authority?

Will innocent parties be hurt by the agreement?  Well, yes, just as is often the case when damages must be paid by any party or entity which has run afoul of regulations or the law.

Is the NCAA acting outside its scope of authority?  Certainly not.  If it were, the University surely would not have accepted the discipline imposed.  When Penn State affiliated with the organization, along with privileges of membership came provisions that were agreed to which enable sanctions to be imposed when deemed appropriate.

 

One as skilled in the law as Governor and former Attorney General Corbett should not have brought this lawsuit.  It was not his finest hour and it is an embarrassment.

 

There is a lot on the plate of Governor Corbett and the General Assembly at this time.  I want my governor to fight for the common good, not to seek preservation of an exalted and formerly untouchable university football program at all costs.

 

I hope that the fight to unravel a valid agreement will now end and that no additional state resources will be devoted to the matter. I also wish for the dismissal of a similarly illogical suit filed against the organization by the Paterno family.
